Terms of Service

1. Provider, scope and language

Loyal Pet is a service of JiDo Data UG (haftungsbeschränkt), Allerstraße 3, 12049 Berlin, Germany, represented by managing director Young Jin Kim ("Loyal Pet", "we" or "us"). The company is registered with Amtsgericht Charlottenburg under HRB 221920 B; VAT ID: DE337853809. General contact, product, support and withdrawal contact: hello@loyalpet.art. These Terms govern contracts concluded through loyalpet.art with consumers under section 13 BGB and business customers under section 14 BGB. Provisions expressly addressed to one group apply only to that group. Customer terms apply only if we expressly agree to them in text form. The contract languages are German and English. If the versions conflict, the German AGB controls.

2. Service and digital delivery

Loyal Pet creates custom digital pet portraits from reference photographs using AI-assisted creation, curation and editing. Depending on the selected product, the service also includes accounts, credit balances, gifts, family sharing, business workspaces, support and entitlement-controlled downloads. Physical printing and shipping are not part of the current service.

A watermarked preview is for evaluation only and grants no right to use a clean file. Clean downloads require a verified payment or a valid gift, family or business entitlement. Format, resolution, credit allocation, seats, usage limits and other characteristics are those shown on the product page and in the order summary.

3. Contract formation and contract text

Product pages, prices and previews invite you to place an order; they are not binding offers. You can review and correct your entries before proceeding to Stripe Checkout. At Stripe, the final payment button and order summary identify the product, total price, currency, billing interval where applicable and available payment method. Activating that clearly labelled payment button submits a binding offer.

An automated acknowledgement confirms receipt but is not acceptance. A contract is concluded when we expressly accept in text form or make the purchased digital content or entitlement available, whichever occurs first. Order data remains visible in an account where the purchase has been claimed. We do not currently provide the complete contract wording as a separately retrievable account document; save or print these Terms and keep the order confirmation and Stripe receipt for your records.

4. Gifts, family plans and business workspaces

A gift purchase contract is between the purchaser and Loyal Pet. The named recipient receives the scoped benefit and does not gain access to the purchaser's private gallery. Redeeming a claim link does not by itself make the recipient a party to the purchase contract. A separate account agreement may arise if the recipient accepts these Terms to use continuing account features.

Family and business administrators may invite members, allocate credits, set usage caps and revoke access within the product limits shown at purchase. They must provide accurate information and may submit another person's contact details only where they are permitted to do so. Loyal Pet remains responsible for its own obligations as data controller; see the Privacy Notice.

5. Prices, payment, subscriptions and cancellation

The catalog is currently priced in US dollars. The binding currency and total price, including applicable VAT and all mandatory price components, are displayed before the order is placed. There are no shipping charges for the digital service. Stripe processes payment; only the payment methods actually offered in Stripe Checkout are available.

One-time products are charged once. Individual, family and business accounts are monthly subscriptions that renew for further monthly periods until cancelled. A subscription can be cancelled through the Stripe billing portal linked from the account order area; cancellation takes effect at the end of the current paid billing period. Access can end earlier after a refund, chargeback or payment reversal to the extent permitted by law.

6. Consumer right of withdrawal

Withdrawal instruction

If you are a consumer, you have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise the right of withdrawal, inform JiDo Data UG (haftungsbeschränkt), trading as Loyal Pet, Allerstraße 3, 12049 Berlin, Germany, emailhello@loyalpet.art, of your decision by an unequivocal statement, for example by letter or email. You may use the model form below, but it is not obligatory. You can also use our electronicWithdraw contract function. When that function is used, we immediately provide a timestamped receipt for download containing the declaration and its receipt date and time, and we also attempt to send it to the email address you provide.

Sending the declaration before the withdrawal period expires is sufficient. If you withdraw, we reimburse all payments received from you without undue delay and no later than fourteen days after receiving the declaration. We use the original payment method unless expressly agreed otherwise, and charge no reimbursement fee.

Digital content supplied before the period expires

For digital content not supplied on a tangible medium, the right of withdrawal expires only under the statutory conditions. For paid content, this requires that performance has begun after your express consent to early performance, your acknowledgement that the right is lost when performance begins, and provision of the required contract confirmation on a durable medium. For Loyal Pet's paid clean file, performance begins when the clean file is made available; internal generation and a pre-purchase watermarked preview do not count.

7. Refunds and statutory remedies

Statutory withdrawal, conformity, termination, price-reduction and damages rights remain unaffected. A valid withdrawal or full refund may revoke the associated clean-file, credit or plan entitlement. Questions about a duplicate charge, failed delivery or a voluntary refund can be sent to hello@loyalpet.art.

8. Digital-product conformity and changes

Mandatory German consumer rules for digital products, including sections 327 et seq. BGB, apply. We provide updates, including security updates, where legally required to maintain conformity. Changes beyond that purpose are made only where section 327r BGB permits them. Statutory remedies for non-supply or lack of conformity are not restricted by these Terms.

9. Your uploads

Upload a photograph only if, to the best of your knowledge, you have the rights and permissions required for the requested use. If another person appears in it, ensure that the intended use is lawful. You grant us a non-exclusive, royalty-free licence limited to storing, reproducing, technically adapting and processing the upload as necessary to create and deliver the requested portrait, operate the account, gift, family or business features, prevent abuse, maintain security and meet legal duties. Our service providers may exercise that limited licence for us.

You retain your rights in uploads. This clause gives us no permission to publish customer material, use it in our advertising or train models on it. Any such use requires separate, specific permission.

10. AI-assisted output and usage rights

The generative process can produce variation. We owe the product characteristics stated in the order, not a particular subjective aesthetic result beyond those characteristics and mandatory conformity standards. Purely machine-generated output may not qualify for copyright protection under German law.

To the extent rights in a final portrait exist and belong to us, a personal entitlement grants a non-exclusive, worldwide, royalty-free and perpetual right to reproduce, display, share and edit it for the customer's own private, non-commercial purposes. An entitlement expressly marked "commercial" additionally permits use in the ordering customer's own business communications and promotion. Neither licence permits sale, sublicensing or distribution of the file itself as a standalone or stock asset. Watermarks, access controls and delivery grants may not be removed or bypassed.

11. Accounts and acceptable use

Provide accurate account information and keep credentials and claim links confidential. A paid contract may be concluded only by a person with the necessary legal capacity or with the required consent of a legal representative. Minors may use account features only with legally required consent and supervision.

Do not use the service unlawfully, infringe intellectual-property, privacy, image or personality rights, submit exploitative or unlawful content, create deceptive depictions of real people without a lawful basis, introduce malicious code, materially disrupt the service, bypass technical protections or resell the service without our agreement.

12. Account closure and suspension

You may request account closure through account settings or in text form. We may restrict access where there are concrete indications of a material Terms breach, unlawful use or a security risk. Measures must be proportionate and are lifted when their basis ends. Closure or suspension does not remove rights and duties from completed purchases, including consumer remedies. Data handling after closure is explained in the Privacy Notice.

13. Liability

We are liable without limitation for intent and gross negligence; culpable injury to life, body or health; liability under the Product Liability Act; an expressly assumed guarantee; and any liability that law does not permit us to limit. For slight negligence involving an essential contractual duty, liability is limited to the foreseeable damage typical for the contract. Liability for other slight negligence is excluded. These rules also apply to our legal representatives, employees and agents. Mandatory consumer rights remain unaffected.

14. Changes, governing law and final provisions

Changes to these Terms for an existing agreement take effect only with your consent or where mandatory law permits or requires the change. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Consumers resident elsewhere retain the protection of mandatory law in their country of residence. For merchants, public-law entities and special public-law funds, Berlin is the exclusive place of jurisdiction; statutory consumer venues remain unaffected. If a provision is ineffective, the statutory rule replaces it and the remaining provisions continue to apply.
